Ok,
Im just curious as to why certain brands can't be shipped to the US? Why can Granit be shipped here but not Gustuvus?

Manufacturer rules, and brand conflicts. One company owns , for example, the Lucky Strike and Camel brands in the US and another owns them in the rest of the world. Also the new FDA regulations are causing a few companies to drop snus to the US altogether.

In the case of Gustavus and LD, JTI sent out a letter asking Swedish eStores not to sell to the USA. Personally, I think it was a CYA letter for FDA. Once the manufacturer sells the product, they no longer have control or liability over where it's sold.

JTI CAMEL Snus is a different story. They never said anything to us about selling or not selling CAMEL Snus in the US. We did sell it for some time until RJR noticed.

Reynolds filed suit against all the Swedish stores selling into the US. None of us could afford a protracted and very expensive legal battle so we surrendered.

Note that Reynolds did not sue JTI or SMD who distributes for JTI in Sweden....just us poor little innocent eSnus stores. And what Mick said.

Rumor Control: The Berne Agreement means the USPS has to deliver tobacco products within the US:

The imported tobacco lobby already tried using the Berne Agreement argument and it doesn’t hold water. If marijuana was legal in the UK, the US Post Office could still refuse to deliver it to the UK and file criminal charges.

For Americans, the problem is getting tobacco products (except cigars) delivered to ANY address in the US; Alaska and Hawaii not included.

In July, the NY District Federal Court did rule in the Seneca Lawsuit to stay this ban for the Seneca’s pending arguments. The Court has since vacated that stay since the plaintiff didn’t make a case that having to use UPS instead of USPS would cause severe damage to their business.

As of now, all snus distributors and retailers with a physical presence in the United States must not ship USPS, must make sure each can has the correct FDA label format, and must collect tobacco tax and sales tax.

Offshore snus eStores like snuscentral.com or buysnus.com cannot ship USPS, must conform to labeling requirements like a Duty Free shop would, and verify age. None of the US State Governments are equipped to collect tobacco taxes from eStores only located in Sweden at this time.

Like with anything else Americans purchase on the internet (for a while longer at least), we are responsible to pay any taxes due to our State Governments.

SnusCentral does prepay the duty and customs to UPS...I don't know about any of the other Swedish location only eStores.

I guess the bottom line is for the foreseeable future, no USPS for Americans. The Seneca lawsuit should do away with that based on US Law. Unfortunately, our courts don't always rule based on law but on judicial activism. Even if the USPS ban is overturned, you're looking at 3 years minimum to work its way up to the Supreme Court.
